Others have brought into question such a movement warning against rights inflation. We argue that we should avoid introducing new fundamental rights in any legal framework whenever possible. We call this the situated approach since whether it is possible to protect the mind without introducing new rights is a question that should be asked in each legal framework separately. We show that in the case of Chile, that can be done, and we propose how. Specifically, we provide a critical assessment of local regulatory proposals and show that, as a result of the local legislative debate, they have evolved from a universalist stance towards a much more situated view. However, we suggest that in their current state, they still are insufficiently grounded in the Chilean legal system, which we regard as providing enough protection against neurotechnological harm in most relevant cases.

This paper will critically analyze the different aspects of the bill, particularly concerning four main dimensions, namely, the patient's condition at the time of requesting euthanasia; the doctor-patient relationship and respect for the autonomy of both parties; the idea of medicine involved in it; and the possible therapeutic alternatives to euthanasia. This critical analysis raises the need to discuss in more depth a project that has to do with such important decisions about our lives and that implies a radical change in the way of thinking and practicing medicine.

Este libro permite una aproximación al quehacer de las universidades chilenas abordando las temáticas que moviluzan a los comités éticocientíficos y ofrece una panorámica de sus aportes en la formación de las buenas prácticas de investigación en las comunidades universitarias. Esta publicación constituye un aporte a la literatura en la gestión de la ética y seguridad en investigación académica desde y para un público hispanohablante que sin duda contribuirá a mejorar estrategias de gestión y desarrollo en estos ámbitos, además de contribuir a la construcción de una sociedad más humana y respetuosa del entorno social, cultural y natural, en el contexto de la generación de conocimientos de alto nivel.
- ItemMedical ethics argumentation: analysis of main topics about medical ethics in clinical practice dealt in national journals of Medicine and Bioethics 1998-2013(UNIV CHILE, CENTRO INTERDISCIPLINARIO ESTUDIOS BIOETICA, 2017) Ramos Vergara, Paulina; Bedregal Garcia, PaulaThe aim of this investigation is to identify the main topics of the discussion about medical ethics in clinical practice in Chile. 143 articles in Chilean medical and bioethics journals were identified. They were put under a systematic study using comparison, codification and text analysis techniques of the Grounded Theory approach. 30 subjects were identified in the discussion, where the treatment of the ethics from a "professional deontology" predominates. Emergent speeches of an ethics that appeals to goods and values superiors to the professional duties in the search of the good of the patient can be found. The transformation of the context in which the clinical practice takes place is the background of the discussion.
- ItemNeurorights in the Constitution: from neurotechnology to ethics and politics(2024) Ruiz, Sergio; Valera, Luca; Ramos Vergara, Paulina; Sitaram, RanganathaNeuroimaging technologies such as brain-computer interfaces and neurofeedback have evolved rapidly as new tools for cognitive neuroscience and as potential clinical interventions. However, along with these developments, concern has grown based on the fear of the potential misuse of neurotechnology. In October 2021, Chile became the first country to include neurorights in its Constitution. The present article is divided into two parts. In the first section, we describe the path followed by neurorights that led to its inclusion in the Chilean Constitution, and the neurotechnologies usually involved in neurorights discussions. In the second part, we discuss two potential problems of neurorights. We begin by pointing out some epistemological concerns regarding neurorights, mainly referring to the ambiguity of the concepts used in neurolegislations, the difficult relationship between neuroscience and politics and the weak reasons for urgency in legislating. We then describe the dangers of overprotective laws in medical research, based on the detrimental effect of recent legislation in Chile and the potential risk posed by neurorights to the benefits of neuroscience development. This article aims to engage with the scientific community interested in neurotechnology and neurorights in an interdisciplinary reflection of the potential consequences of neurorights.This article is part of the theme issue 'Neurofeedback: new territories and neurocognitive mechanisms of endogenous neuromodulation'.

From these arises the need to norm the application of these techniques with the goal to protect life in compliance with constitutional mandate. This is a descriptive historical study grounded on the review of Chilean project laws regulating the issue - direct and indirectly - between 1996 and 2013. It is concluded that is urgent to regulate a juridical statue of the unborn conceived to guaranty the effective integrity of his/her life.
